the Ministry of justice of Russia has published a new draft of the administrative code, as amended. The Agency proposes to extend the possibility of paying half the amount of the fine for all offenses, except rude.
the changes also included more loyal to the penalties for violation of rules of an accomplishment of territory of municipal formations. The decision was taken to ensure a fair and proportionate approach to administrative punishment.
the Ministry noted that the current amounts of punishment and period of limitation for bringing to administrative responsibility in the new draft of the administrative code will not be increased, reports TASS.
Instead of fines for administrative offences to citizens more able to apply warning — this possibility is provided in the provisions of articles 263 of the administrative code.
the Ministry of justice also contributed to the new draft order and peculiarities of bringing to administrative liability of minors. These include the types of penalties, including warning, fine, community service, ban on visiting of venues of official sports competitions and so on. For example, the amount of the fine may not exceed five thousand rubles, and assigned only if the minor has independent earnings. The period of compulsory work can not be higher than thirty hours.
In the new draft administrative code will also be returned to the presumption of innocence, because this fundamental principle is important.
According to the amendments, a citizen in some cases will be able to obtain the possibility of granting him free legal aid. This can be used when the person for committing an administrative offence can be punished with detention.
